Tony Stewart Asks Judge To Dismiss Wrongful Death Claim


Racer Tony Stewart is asking a judge to dismiss a wrongful death lawsuit.  The NASCAR team owner filed the motion with a federal judge yesterday.  The lawsuit stems from a crash three years ago at Canandaigua Motorsports Park that ended in the death of a North Country driver.  Stewart was racing on the dirt track in August 2014 when 20-year-old Kevin Ward Jr. left his car after crashing.  He stepped out on the track, waving his arms and pointing at Stewart.  Ward's family says Stewart was reckless and gunning his engine under a yellow flag causing it to slide and hit Ward.  A grand jury later cleared Stewart.
